Terms & Conditions
These Terms govern your access to and use of c0dename.com, every page, form and material on it, and any briefing, demonstration, call or correspondence that follows from it (together, the "Site"). The Site is operated by c0dename ("we", "us").
By accessing the Site, ticking the acceptance box on our enquiry form, submitting an enquiry or taking part in a briefing, you accept these Terms and confirm that you have read our Privacy Policy. If you act on behalf of an organisation, you confirm that you are authorised to bind it, and "you" includes that organisation. If you do not accept these Terms, do not use the Site.
1. Eligibility
The Site is intended only for professionals in defence, security, government and related industries, acting in a business or official capacity. It is not intended for consumers or for anyone under 18. You confirm that you are not acting as a consumer.
You may not use the Site, submit an enquiry, attend a briefing or receive any information from us if you, your organisation, any person owning or controlling it, or any intended end user:
- is located in, organised under the laws of, or ordinarily resident in a country or territory subject to comprehensive sanctions, including the Russian Federation, the Republic of Belarus, Iran, North Korea, Syria, Cuba, and the temporarily occupied territories of Ukraine;
- is listed on, or is owned 50% or more or controlled by a person listed on, any sanctions, export control or restricted-party list maintained by Ukraine, the European Union, the United Kingdom, the United States or the United Nations;
- acts directly or indirectly for or on behalf of any of the above.
Each time you use the Site, you represent and warrant that none of the above applies and that all information you give us is accurate, complete and given with authority.
We may verify your identity, organisation, role and intended end use, screen you against sanctions and restricted-party lists, and require a signed non-disclosure agreement or other documents before any briefing. We may refuse, ignore, pause or end any enquiry or relationship at our sole discretion, at any time, without giving reasons.
2. No offer, no commitment
Everything on the Site is general information. It is not an offer, a quotation, a tender response, a representation of fitness for any purpose, or a commitment to supply any product or service.
Workflows, scenarios, interfaces, figures, capabilities and use cases shown on the Site or in any briefing are illustrative. They are not claims of field deployment, operational performance, certification, accreditation, customer use or endorsement by any government, armed force or other organisation, unless expressly stated in a signed agreement.
Any supply of products or services is governed solely by a separate written agreement signed by our authorised representative. That agreement prevails over the Site and these Terms. Nothing said or shown in a briefing, demonstration, call or email creates a binding obligation, or forms part of any contract, unless it is set out in that agreement.
3. Lawful use and end use
Our products are intended solely for lawful use by lawful end users, in compliance with applicable law, including international humanitarian law, sanctions and export control law. We may decline any enquiry or engagement where we believe an intended use could breach any such law.
Information we provide may be subject to export control and sanctions law. You must not export, re-export, transfer or disclose it in breach of that law, or to any person or destination described in section 1. You are solely responsible for your own compliance with sanctions and export control law. If sanctions or export control law changes so that dealing with you would be restricted, we may end all contact with you immediately.
You must not offer, promise or give, directly or indirectly, any payment, gift, hospitality or other advantage to us, our personnel or any public official in connection with the Site or any potential engagement with us, where doing so could breach any anti-bribery or anti-corruption law, including the UK Bribery Act 2010, the US Foreign Corrupt Practices Act and Ukrainian anti-corruption law. You must tell us immediately at hello@c0dename.com if you receive or become aware of any request for such an advantage in connection with us.
4. What you must not send us
Do not send us through the Site, by email or through any other unsolicited channel:
- classified information, or information carrying a security marking or handling restriction;
- operationally sensitive information, including locations, movements, capabilities, readiness or vulnerabilities of any armed force, unit or facility;
- technical data, software or technology subject to export control;
- special-category personal data, or personal data of others that you are not authorised to share.
If you send such material, you do so at your own risk and remain solely responsible for it. We are not obliged to keep unsolicited material confidential, and we may delete it without reading, using or responding to it. Confidentiality obligations on our side arise only under a signed non-disclosure or other written agreement.
5. Our confidential information
Information we disclose to you that is not publicly available on the Site, including anything shown or said in a briefing or demonstration, and any pricing, roadmap, architecture or technical detail, is our confidential information. You must keep it confidential, use it only to evaluate a business relationship with us, and share it only with your personnel who need it for that purpose and are bound by equivalent confidentiality obligations. You must not record a briefing or demonstration without our prior written consent. These obligations survive for five years after disclosure, or longer where a signed agreement says so. You agree that damages alone may not be an adequate remedy for a breach of this section, and that we may seek an injunction, specific performance or other equitable relief in any court of competent jurisdiction, without proving special damage.
6. Acceptable use
You must not, and must not allow anyone else to:
- use the Site in breach of any applicable law, sanctions or export control regime;
- attempt to gain unauthorised access to the Site, our systems, or any account or data;
- probe, scan or test the vulnerability of the Site, or bypass any security or access control, except under section 7;
- scrape, harvest, crawl, index or extract content or data from the Site by automated means, or use any content from the Site to train, fine-tune, evaluate or prompt any AI model;
- copy, frame, mirror, modify, decompile, reverse engineer or create derivative works from the Site or its content;
- submit false, misleading or impersonating information, or act on behalf of anyone without authority;
- introduce malware or interfere with the operation of the Site;
- use the Site, a briefing or our confidential information to gather competitive intelligence, or to build, benchmark or promote a competing product or service;
- state or imply publicly that you have a relationship with us, or disclose that you have been in contact with us, without our prior written consent.
7. Security research
If you believe you have found a security vulnerability, report it to hello@c0dename.com with enough detail for us to reproduce it. Do not access, change or delete data that is not yours, do not degrade the Site, and do not disclose the vulnerability to anyone until we have fixed it or agreed in writing that you may. If you act in good faith and within these limits, we will not take action against you for the research itself.
8. Intellectual property
The Site and all its content, including text, graphics, interfaces, illustrations, code, logos, names and the c0dename brand, are owned by or licensed to us and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to view the Site solely to evaluate a business relationship with us. All other rights are reserved.
You must not use our name, logo or brand in any way that suggests a relationship with, endorsement by or affiliation with us without our prior written consent.
9. Feedback
If you give us suggestions, ideas or feedback about our products or services, we may use them for any purpose, without restriction, attribution or payment to you.
10. Third-party links
The Site may link to third-party websites. We do not control them and are not responsible for their content, availability, security or practices. A link is not an endorsement.
11. Availability and changes
We may change, suspend or withdraw all or part of the Site at any time without notice. We do not guarantee that the Site will be available, uninterrupted, accurate, complete, current, secure or free of errors or harmful components.
12. Disclaimer
The Site, its content and any briefing or demonstration are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and representations, express or implied, including those of satisfactory quality, merchantability, fitness for a particular purpose, accuracy and non-infringement.
You must not rely on the Site, a briefing or a demonstration for any operational, tactical, targeting, safety, procurement or investment decision. Decisions of that kind remain solely yours.
13. Limitation of liability
To the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any loss of profits, revenue, business, contracts, data, goodwill or anticipated savings, arising from or in connection with the Site or these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable;
- our total aggregate liability arising from or in connection with the Site or these Terms is limited to GBP 100;
- any claim against us must be brought within one year after the facts giving rise to it first occurred, or it is permanently barred.
We provide the Site free of charge, and you agree that these limits are reasonable in that light.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
14. Indemnity
You will indemnify and hold harmless c0dename and its officers, employees and contractors (the "Indemnified Persons") from any claim, loss, liability, penalty, cost or expense (including reasonable legal fees) arising from your breach of these Terms, any inaccurate representation you make under section 1, your breach of any sanctions or export control law, your misuse of the Site or our confidential information, or any material you send us.
15. Suspension
We may restrict or terminate your access to the Site, or end any discussion with you, at any time and without notice, if we believe you have breached these Terms or any applicable law, or to protect the Site, our business or others. Sections 3 to 6, 8, 9 and 12 to 20 survive.
16. Events beyond our control
We are not responsible for any failure or delay caused by events beyond our reasonable control, including war, hostilities, military action, cyber attack, power or network failure, sanctions or government action.
17. Changes to these Terms
We may update these Terms at any time by posting a new version on this page. The version in force when you use the Site applies.
18. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site and supersede any prior understanding about it. You confirm that you have not relied on any statement, representation or assurance that is not set out in these Terms, and you will have no remedy in respect of one. If these Terms conflict with a signed agreement between you and us, the signed agreement prevails; otherwise, these Terms prevail over anything else on the Site. If any provision is found unenforceable, it is modified to the minimum extent needed and the rest remains in effect. Our failure or delay in enforcing a right is not a waiver of it. You may not assign or transfer your rights or obligations under these Terms. We may assign or transfer ours to any successor or to any person that operates the Site. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship. The Indemnified Persons may enforce section 14. No other third party has any right to enforce these Terms. These Terms are written in English, and any translation is for convenience only. "Including" means including without limitation.
We may give you notices by email to the address you gave us or by posting them on the Site. You must send notices to us by email to hello@c0dename.com. A notice by email is treated as received when sent, unless the sender receives a delivery failure message. You agree that communications in electronic form satisfy any legal requirement that they be in writing.
If you are a government body and the law that applies to you prevents you from accepting a provision of these Terms, that provision applies to you only to the extent that law permits, and the rest of these Terms continue to apply.
19. Governing law and jurisdiction
These Terms and any dispute or claim arising from or in connection with them or the Site, including non-contractual disputes, are governed by the laws of England and Wales.
Any such dispute, including any question about the existence, validity or termination of these Terms, will be referred to and finally resolved by arbitration under the LCIA Rules, which are incorporated into this section by reference. There will be one arbitrator. The seat of arbitration is London, England. The language of the arbitration is English. The arbitration, its existence, all submissions and any award are confidential, except as needed to enforce an award or as the law requires.
Nothing in this section prevents us from seeking an injunction or other interim or urgent relief from any court of competent jurisdiction.
